FULL TERMS:
1.The $5 Off First Delivery Promotional Offer (“Promotion”): Between January 4, 2021 and January 31, 2021 (“Promotion Period”), customers who have never before ordered for delivery on the Little Caesars mobile app (“App”) or online at LittleCaesars.com (“Site”) will get a $5 credit (“$5 Credit”) on their first delivery of any pizza (“Qualifying Pizza Purchase”) when they order via the App or Site in accordance with these Terms and Conditions (“Terms”). To redeem the Offer, Eligible Customers (defined below in Section 2) must (i) obtain a valid promo code (“Promo Code”), which Sponsor will make available on in-store materials, TV and its social media platforms; (ii) place their Qualifying Pizza Purchase in the cart; and (iii) enter the valid Promo Code at checkout. The $5 Credit will be deducted from the Eligible Customer’s order for delivery at check-out. Promo Code numbers may vary depending on how they are communicated, but each Promo Code will entitle an Eligible Customer to the same $5 Credit regardless of the Promo Code number.
OFFER REDEEMABLE ONLY WITH ONLINE AND APP ORDERS FOR DELIVERY MADE THROUGH LITTLE CAESARS AND NOT REDEEMABLE ON IN-STORE ORDERS OR PIZZA PORTAL® PICK-UP ORDERS OR ON THIRD-PARTY ONLINE SITES OR IN ANY MANNER OTHER THAN PROVIDED HEREIN.
Delivery available from participating locations only with online orders. Delivery fees apply. Small order fee for delivery orders less than $10. Small order fee will be applied prior to deduction of the $5 Credit. Plus Tax.
2. Eligibility: Offer available to customers located in the 50 United States and D.C., who have never before ordered for delivery via the App or Site (as determined by Sponsor in its sole and absolute discretion) (each an “Eligible Customer”). If a customer has ordered for delivery via the App or Site, customer will not be able to redeem the Offer. Only available on an Eligible Customer’s first order for delivery via the App or Site. Sponsor will verify “first order” based on Eligible Customer’s account ID, email address and/or credit card, as determined by Sponsor in its sole and absolute discretion. Offer good only at participating Little Caesars stores (each a “Participating Store”), excluding stadium, Kmart and Little Caesars Express locations. Void where prohibited, taxed or restricted by law. Employees, officers and directors of Little Caesar Enterprises, Inc. (“Sponsor”) are not eligible to participate. All federal, state and local laws and regulations apply.
3. $5 Credit: Limit one (1) $5 Credit per Eligible Customer throughout the Promotion Period. Cannot be combined with any other promo code offers. $5 Credit must be redeemed on a single transaction and not over multiple transactions. No substitutions or cash redemptions by customer. All applicable taxes are the sole responsibility of the customer (if any).
4. General Conditions: Participating Stores each reserve the right in their sole discretion to prohibit delivery to and/or not give the $5 Credit to any individual they find to be engaging in fraud or undermining the legitimate operation of this Promotion or acting in an abusive, fraudulent, deceptive or disruptive manner or in violation of these Terms. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law and, should such an attempt be made, Participating Stores reserve the right to seek damages from any such person to the fullest extent permitted by law. Each Participating Store reserves the right to make the final decision with respect admission and/or redemption and fulfillment of $5 Credit, in its sole discretion. Not all Little Caesars stores or franchisees participate in this Promotion and Released Parties cannot be held responsible for this decision.
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Promotion (in its sole discretion) and without prior notice or obligation in the event of: (i) any virus, bugs, non-authorized human intervention, cheating, fraud, epidemics, pandemics, or other causes beyond the control of the Sponsor corrupt or affect the administration, security, fairness or proper conduct of the Promotion; (ii) any error, technical problem, fraud or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Promotion and/or any Promo Codes as contemplated by these Terms; and/or (iii) any accident, printing, administrative or other error or any kind.
Void where prohibited or expired. Sponsor is not responsible for late, non-compliant or misdirected requests. Requests not complying with all offer requirements will not be honored. Duplicate requests will constitute fraud.
By participating, you agree to release and hold harmless Sponsor, its franchisees, Participating Stores and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Parties”), from and against any liability, loss, claims or causes of action arising out of participation in the Promotion and/or receipt or use of the $5 Credit and/or any Promo Codes, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical, printing, hardware, software, mobile, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet or ISP availability, unauthorized human intervention, traffic congestion or failed, incomplete, garbled, jumbled or delayed computer or mobile transmissions which may limit one’s ability to participate in the Promotion; (c) errors in the administration of the Promotion or the processing, fulfillment or redemption of requests, the $5 Credit or any Promo Codes; (d) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Promotion or receipt or use of any $5 Credit; or (e) a store or franchisee’s non-participation in this Promotion or failure to provide the $5 Credit for whatever reason. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages.
5. Disputes: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of or connected with, the Promotion or any $5 Credits awarded shall be resolved individually, without resort to any form of class action and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Wayne County, Michigan. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, your rights and obligations or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by and construed in accordance with, the laws of Michigan, without giving effect to any choice of law or conflict of law rules (whether of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Michigan.

2. La oferta es nula donde esté prohibido, gravado o restringido por ley. Los empleados, funcionarios y directores de Little Caesar Enterprises, Inc. (“Patrocinador”) no son elegibles para participar. Cualquier intento por parte de cualquier persona de socavar la operación legítima de la Promoción puede ser una infracción de las leyes penales y civiles y, en caso de que se haga tal intento, las Tiendas Participantes se reservan el derecho de reclamar daños y perjuicios a dicha persona en la máxima medida permitida por la ley. Cada Tienda Participante se reserva el derecho de tomar la decisión final con respecto a la admisión y/o el canje y el cumplimiento del Crédito de $5, a su exclusiva discreción. No todas las tiendas o franquiciados de Little Caesars participan en esta Promoción y las Partes Exoneradas no pueden considerarse responsables por esta decisión.
El Patrocinador se reserva el derecho, a su exclusiva discreción, de cancelar, terminar, modificar, extender o suspender esta Promoción (a su exclusiva discreción) y sin previo aviso u obligación en el caso de: (i) cualquier virus, error, intervención humana no autorizada, engaño, fraude, epidemias, pandemias u otras causas fuera del control del Patrocinador que dañen o afecten la administración, seguridad, equidad o ejecución adecuada de la Promoción; (ii) cualquier error, problema técnico, fraude o cualquier otra causa más allá del control razonable del Patrocinador que interfiera con la ejecución adecuada de esta Promoción y/o de cualquier Código de Promoción según lo contemplado en estos Términos; y/o (iii) cualquier accidente, error de impresión, error administrativo u otro error de cualquier tipo.
No válido donde esté prohibido o haya caducado. El Patrocinador no se hace responsable por solicitudes atrasadas, equivocadas o que no cumplen las condiciones. No se aceptarán solicitudes que no cumplan con todos los requisitos. Las solicitudes duplicadas constituyen fraude.
Al participar, usted acepta liberar y eximir de responsabilidad al Patrocinador, sus franquiciados, las Tiendas Participantes y sus respectivas empresas matrices, subsidiarias, afiliadas, socios, representantes, agentes, sucesores, asignados, empleados, funcionarios y directores (colectivamente, las “Partes Exoneradas”), de y contra cualquier responsabilidad, pérdida, reclamo o causa de acción que surja de la participación en la Promoción y/o la recepción o el uso del Crédito de $5 y/o de cualquier Código Promocional, incluidos, entre otros: (a) intervención humana no autorizada en la Promoción; (b) fallas técnicas, de impresión, hardware, software, de comunicaciones móviles, telefónicas o de otro tipo, errores o fallas de cualquier tipo, pérdidas o falta de disponibilidad de conexiones de red, sitio web, disponibilidad de Internet o ISP, intervención humana no autorizada, congestión de tráfico o transmisiones informáticas o móviles fallidas, incompletas, confusas, entrecruzadas o retrasadas que pueden limitar la capacidad de participar en la Promoción; (c) errores en la administración de la Promoción o el procesamiento, cumplimiento o canje de solicitudes, del Crédito de $5 o de cualquier Código Promocional; (d) lesiones o daños a personas o a la propiedad que puedan ser causados, directa o indirectamente, de manera total o parcial, por su participación en la Promoción o la recepción o uso de cualquier Crédito de $5; o (e) la no participación de una tienda o franquiciado en esta Promoción o el hecho de no proporcionar el Crédito de $5 por cualquier motivo. 5. Disputas: Excepto donde esté prohibido, usted acepta que todas y cada una de las disputas, reclamaciones y causas de acción que surjan o tengan relación con la Promoción o cualquier Crédito de $5 otorgado serán resueltas de manera individual, sin recurrir a ninguna forma de demanda colectiva y exclusivamente por el Tribunal de Distrito de los Estados Unidos para el Distrito Este de Michigan (División Sur) o el Tribunal del Estado de Michigan correspondiente ubicado en el condado de Wayne, Michigan.
